Final Notice and Public Explanation of a Proposed Activity in a Federal Flood Risk Management Standard Designated Floodplain

This is to give notice that The Paulding County Commissioners under 24 CFR Part 58 have conducted an evaluation as required by Executive Order(s) 11988, as amended by Executive Order 13690, and/or Executive Order 11990, in accordance with HUD regulations at 24 CFR 55.20 in Subpart C Procedures for Making Determinations on Floodplain Management and Wetlands Protection. The activity is funded under the Community Development Block Grant Allocation Program, B-F-24-1CF-2 . The proposed project(s) is located Orchard Street in The Village of Payne, Paulding County and is located in the [Federal Flood Risk Management Standard (FFRMS) floodplain. The extent of the FFRMS floodplain was determined using 0.2 percent flood approach. The proposed activity includes the removal and replacement of 2,600 sf of sidewalk and adding an additional 7,000 sf of sidewalk on the North Side of Orchard Street from Maple Street to the Flat Rock Creek Apartments. This also includes the addition of 6 ADA ramps, pavement markings, seeding and mulching. Roughly 0.2 acres of this project is taking place in the 0.2% Annual Chance Flood Hazard area.
The Paulding County Commissioners have considered the following alternatives and mitigation measures to minimize adverse impacts and to restore and preserve natural and beneficial functions and intrinsic values of the existing floodplain/wetland. The first alternative considered was to locate the proposed project in an area outside of the FFRMS floodplain on the existing project site. This is not feasible as this would relocate the sidewalk further into private property owner’s land. The second alternative was to construct the sidewalk using methods that are compliant with local floodplain regulations and ordinances, which was deemed a feasible alternative. The final alternative considered was no action. This alternative was deemed not feasible as this would not provide the necessary improvements needed to provide safe pedestrian access to the sidewalk. To ensure compliance with floodplain regulations & to restore and preserve natural and beneficial functions and intrinsic values of the existing floodplain, all required special permits will be acquired by the contractor. Additionally, when feasible, the sidewalk will be elevated above the base flood elevation to minimize flood damage and to comply with local floodplain management ordinances. The local permitting authority will be contacted prior to construction start.
The Paulding County Commissioners have reevaluated alternatives to building in the floodplain and has determined that it has no practicable alternative to floodplain development. Environmental files documenting compliance with Executive Order 11988, as amended by Executive Order 13690, and/or Executive Order 11990, are available for public inspection, review and copying upon request at the times and location delineated in the last paragraph of this notice for receipt of comments.
There are three primary purposes for this notice. First, people who may be affected by activities in floodplain and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas. Second, an adequate public notice program can be an important public educational tool. The dissemination of information and request for public comment about floodplain can facilitate and enhance Federal efforts to reduce the risks and impacts associated with the occupancy and modification of these special areas. Third, as a matter of fairness, when the Federal government determines it will participate in actions taking place in floodplain, it must inform those who may be put at greater or continued risk.

This proposal is for the development and operation by a “Provider” of a high-speed fiber network for the citizens and businesses in the Service Area. The objectives are to establish a Network that:
- Is able to offer retail broadband connection of 1 Gbps and at least 700Mbps throughput download speed over each connection provided to a premises;
- Is able to support high quality data and video [cable TV] services;
- Uses fiber-to-the-premises network architecture;
- Covers 100 percent of homes and small businesses in the Service Area;
- Is rolled out and made operational progressively, on a demand driven basis, over 2 years from the date of execution of a contract.
The bidder awarded the contract must provide a performance bond executed by a surety company authorized to do business in the State of Ohio, in an amount equal to the bid. Said performance bond will be required upon signing the contract for this project.
Bids may be hand delivered or mailed in a sealed envelope to Paulding County Commissioners, 451 McDonald Pike Suite E Paulding, OH 45879, and bearing the Bidder’s name and address and marked “RFP for (FTTH) Network Construction and Operation in the Village of Broughton”.

The Ohio Department of Development’s Office of Community Development is has partnered with the Ohio Department of Health (ODH) to make funds available for the Community Housing Impact & Preservation – Lead Abatement Program (CHIP-LAP). The CHIP-LAP Program will include funding for Equipment and/or Lead-Abatement activity costs associated with eliminating lead-based paint hazards in homes receiving CHIP Program Assistance.
Defiance County is the lead entity in the Maumee Valley South CHIP Consortium (MVSCC), which includes Defiance County, Paulding County and the City of Defiance. Defiance County submitted an application for CHIP funds on June 22, 2022 for funding on behalf of the MVSCC. Defiance County intends to apply for CHIP-LAP funds, with the application deadline of September 28, 2022.
The Public Hearings for the CHIP-LAP Program will be held as follows:
Monday, September 19, 2022 at 11:00 a.m. in the Defiance County Commissioner’s Chambers located at 500 Court Street, Suite A, Defiance OH 43512.
Wednesday, September 21, 2022 at 11 a.m. in the Paulding County Commissioner’s Chambers located at 451 McDonald Pike, Suite E, Paulding OH 45879.
The public hearing gives citizens the opportunity to review and comment on the CHIP-LAP activities. Citizens are encouraged to attend any or all meetings listed above to express their views and comments on the Maumee Valley South CHIP Consortium Program application.
